In order to have LaMorte & Associates file a patent application in the United States that relies upon the priority of a foreign patent application, the following materials are required :
1. a certified copy of the patent application from the Patent Office of the foreign country where the patent application was originally filed;
2. a copy of the WIPO patent application if the patent application was filed internationally; and
3. an English translation of the patent application, if it has not yet been published in English.
It is also highly recommended that the claims of the patent application be " americanized ". The direct translation of a non-English patent application into English often results in a patent application that has poorly worded claims. It typically takes an attorney from this office about 2-3 hours to " americanize " the patent application. That is, to reword the patent so that it is in the form, style and wording expected by the United States Patent Office.
This proactive step eliminates many causes of rejection and saves many hundreds of dollars in future patent prosecution fees.
